대한민국 정부는 쌍용 자동차 파업 노동자들에 대한 탄압을 즉각 중단하라

(2009년 7월29일, 방콕) 포럼아시아(FORUM-ASIA)는 파업 중인 쌍용 자동차 노동자들에 대한 대한민국 정부와 쌍용 자동차의 무자비한 탄압을 강력히 비난한다. 포럼아시아는 노동자, 정부 또는 쌍용 자동차 간의 평화적인 3자 협상을 요구하며 현재 자행되고 있는 억압적인 조치들을 즉각 중단할 것을 요구한다.
 
작년 4월, 쌍용자동차는 구조조정 과정에서3,000여명의 노동자들을 해고하였다. 당시 사측과 노측은 협상 과정에서 합의에 도달하지 못했고, 노동자들과 노동조합은 평택에 위치한 쌍용 자동차 공장을 점거하고 파업에 돌입했다. 오늘(2009년 7월 29일)까지 파업은 69일째 지속되고있다.

노동자들은 회사측과 정부에게 공정하고 정당한 합의를 이끌어 내기 위한 절차를 밟을 것을 요구하고 있다. 그러나 대한민국 정부는 공정한 중재자의 역할을 하기보다는 경찰력을 동원해 노동자들에게 최루액을 뿌리고 테이저 건을 발사하는 등, 폭력적으로 탄압하고 있다. 이 과정에서 테이저 건을 얼굴에 직접 맞은 노동자 한 명은 큰 상처를 입기도 했다. 또한 사측은 7월 25일 예정되었던 노조와의 교섭 회의에도 나타나지 않았다. 

파업 기간 동안, 극도의 스트레스로 인해 노동자 두 명이 사망했고  희망퇴직한 노동자 두 명은 자살을 택했다. 노동자들 뿐만 아니라 그 가족들도 이러한 상황 아래 고통받고 있다. 최근 7월20일에는 노동조합 간부의 부인이 경제적인 어려움과 해고를 강행하겠다는 회사측의 위협으로 인해 발생한 정신적인 스트레스로 인해 자살을 하였다. 다섯 명이 사망한 이 비극적인 사태에도 불구하고 쌍용자동차는 파업중인 노동자들을 범죄자로 몰아가는 것 외에는 어떠한 해결책을 찾고 있지 않다.

7월16일부터 지금까지, 물 (식수와 소화전에 공급되는 물 포함), 가스 또는 음식이 공장 안으로 지급되는 것이 쌍용자동차 회사와 경찰에 의해 저지되고 있다. 공장 안으로 식수 및 식량을 전달하려 하는 시민사회 및 야당 의원들을 지속적으로 회사에 의해 저지당하고 있다. 심지어 의료팀도 공장 안으로 들어갈 수 없는 상황이다. 적어도 공장 안에는 약 100여명들의 부상자들이 치료도 받지 못한 채 농성을 하고 있는 것으로 알려졌다. 이들 중 대부분은 경찰의 진압 과정에서 심각한 타박상을 입었고 한 노동자는 골절을 입어 고생을 하고 있다. 또한 지속적인 인슐린 공급이 필요한 당뇨병을 앓고 있는 한 노동자는 지난 15일동안 인슐린 공급을 받지 못해 고통받고 있다.

포럼아시아는 정부와 회사 측이 공장 내 파업 노동자들에게 필요한 의료 지원, 식수, 음식, 전기 등의 인도적 지원을 보장할 것을 강력하게 요구한다. 또한 우리는 정부의 무자비한 탄압을 비판하며 즉시 이러한 탄압을 중단할 것을 요구한다. 쌍용 자동차 사태는 폭력이 아닌 평화적인 협상에 의해 해결되어야만 한다.

대한민국은 국제노동기구 (ILO)의 회원국이며 파업권은 국제노동기구에서 인정한 노동자들의 기본권이다. 또한 2001년 유엔 사회권규약위원회(UN Committee on Economic, Social and Cultural rights)은 대한민국 정부에게 보낸 최종 권고안에서 파업을 범법행위로 규정하는 대한민국 정부의 태도와 공권력의 과도한 개입에 대해 심각한 우려를 표명한 바 있다.

다가오는 2009년 11월, 유엔 사회권 규약 위원회는 대한민국 정부 보고서를 심의할 예정이다. 이 심의 과정에서 쌍용자동차 사태가 거론될 것은 명백하다.

South Korea: Stop Crackdown on Striking Workers of the Ssangyong Motor Company!

(29 July 2009, Bangkok) Asian Forum for Human Rights and Development (FORUM-ASIA) strongly condemns the brutal crackdown on the striking workers of the Ssangyong Motor Company by the Government of the Republic of Korea and the Ssangyong Motor Company. We call for genuine tripartite negotiations between the workers, the Government and the Ssangyong Motor Company and for an end to the repressive measures being used against the striking workers.

Last April, Ssangyong Motor Company fired around three thousand workers during their structural adjustment process. Subsequent negotiations between the company and the labour union failed to produce an agreement that was satisfactory for both sides. As a consequence, the workers and the labour union went on a strike and occupied the Pyungtaek factory of the Ssangyong Motor Company. As of today, the strike has lasted for 69 days.

The workers and the labour union demanded that the Government and the motor company take genuine steps to negotiate a fair and just settlement. However, rather than playing the role of an impartial arbitrator, the Government dispatched police forces to crack down on the striking workers, firing tear gas from helicopters and using taser guns against them, which resulted in one worker being shot in the face. In the meantime, the company failed to attend a pre-arranged meeting with the labour union on 25th July.

During this strike, two workers have died because of extreme stress from the dismissal and another two workers who had accepted voluntary redundancy committed suicide. Furthermore, it is not only the workers but also their family members who are suffering under this situation. On 20 July, the wife of a labour union member committed suicide due to mental stress because of financial difficulties and threats of legal action from the company. While five people have died during this catastrophic situation, the Ssangyong Motor Company keeps vilifying the striking workers as criminals and has not demonstrated any goodwill by trying to find a satisfactory solution to the problems.

From 16th July until now, supplies of water including drinking water and water for fire extinguishers, gas and food have been stopped by the company and the police.  Civil society’s and opposition political parties’ efforts to deliver water and food inside the factory have been continuously blocked by the company. Even medical personnel could not enter the occupied factory. There are estimated to be around 100 injured people inside the factory who are unable to receive vital medical treatment. Many of them are suffering from extensive bruising and fractured ribs, inflicted during the police crackdown. One of the workers has diabetes and requires a constant supply of insulin which he has been unable to obtain for the last 15 days.

FORUM-ASIA strongly urges the Government and the Ssangyong Motor Company to immediately restore access to medical treatment, water, food and electricity for the striking workers. We denounce and call on the Government to immediately end the heavy-handed crackdown. Ssangyong Motor Company’s situation should be resolved through peaceful negotiations, not through violence.

The Republic of Korea is a member of the International Labour Organisation (ILO) and the right to strike is held by the ILO supervisory bodies to be a fundamental right of workers. Furthermore, in its concluding observations to the Republic of Korea in 2001, the UN Committee on Economic, Social and Cultural Rights (CESCR) expressed its grave concerns about the unacceptable approach taken to criminalise strikes and the use of excessive force by the police against labour demonstrations.  

We would like to remind the Government of the Republic of Korea that in November 2009, the country will again be under review by the UN CESCR. There is no doubt that the current situation involving the Ssangyong Motor Company will be raised during this review process.

포럼 아시아(FORUM-ASIA)는 버마 군부, ‘국가평화발전위원회(the State Peace and Development Council, 이하 SPDC)’가 아웅산 수치 여사의 가택연금을 연장한 것을 규탄한다. 또한 수치 여사와 버마의 모든 정치범들을 석방하는 즉각적인 조치를 취할 것을 촉구한다.

버마의 민주주의를 위해 앞장서온 지도자이자 민주주의민족동맹(National Democratic League)의 대표인 수치 여사는 지난 18년 동안 12년에 걸쳐 가택연금을 당해왔다. 

2008년 5월 27일 화요일에 버마 군부의 당국자들은 이러한 수치 여사의 가택연금이 일 년 더 연장되었음을 공식 발표했다.

포럼 아시아는 버마 군부의 이러한 조치는 부당하며 법적 근거도 없는 것으로 규정한다. 이는 국제권원칙 또한 명백하게 위반하는 행위이다.

포럼 아시아의 이사 대행인 얍 스위 셍(Mr. Yap Swee Seng)씨는 다음와 같이 밝혔다. “우리는 수치 여사의 가택연금이 연장된 것이 의미하는 바에 대해 매우 우려하고 있다. 이것은 SPDC가 버마 국민들을 계속 강압적으로 지배하려 할 뿐, 인권 존중 의사가 전혀 없다는 우리의 생각을 재확인시켜 준 것이나 다름없다.”

또한 포럼 아시아는 ASEAN이 이러한 문제에 대해 미리 대책을 강구하지 않은 점에 대해 우려를 표한다. ASEAN은 동남아 지역의 인권을 보호하고 증진해야 할 “인권 단체”의 설립을 위해 만들어진 지역 단체이다. 따라서 ASEAN은 적극적으로 SPDC가 국제인권원칙에 따르도록 요구해야 한다.

시민적, 정치적 권리에 관한 국제규약(ICCPR)에 따르면, 모든 사람은 인간으로서의 자유와 안전에 대한 권리를 갖고 있어서, “법적인 근거가 없이 자유를 침해당할 수 없다.”

포럼 아시아는 SPDC가 인권을 존중하고 민주주의로 이행하는데 헌신할 것을 촉구한다. 또한 아웅산 수치 여사와 버마의 모든 정치범들을 즉각 석방할 것을 요구한다.
